Annual Leave

After one year of service, employees are entitled to remunerated annual leave under the DRC labor code. 

- A minimum of one day of leave per month of service for employees over the age of 18

- A minimum of one and a half days of leave per full month of service for employees under the age of eighteen

This will increase by one day per month for every five years of employment with the same or a substitute employer.

Maternity Leave 

Female employees who have worked for the company for a minimum of six months are entitled to 14 weeks of maternity leave at a rate of at least 67 percent of their normal wage. Employees may begin taking paid leave while pregnant and must ensure that no more than eight weeks of leave is taken following childbirth. Employees who have worked for the company for less than six months are entitled to unpaid maternity leave. Employees are entitled to a daily hour break for breastfeeding.

Paternity Leave

Male employees are entitled to a minimum of two days of paid paternity leave. 

Sick Leave 

After three months of continuous service, employees with fixed-term contracts of more than six months and employees with open-ended contracts are entitled to sick leave. The first 10 days will be paid at full basic salary, with subsequent days reduced in ten-day increments. If an employee is unable to return to work after 30 consecutive days, the contract will be suspended for the duration of the temporary leave of absence. If the suspension is due to work-related reasons, two-thirds of the wage and the full child care allowance will be paid for a maximum of six months.

Termination process

 There are two types of employment contracts in DRC Congo i.e.  Fixed-term or open-ended. In the absence of a formal contract, the agreement is generally assumed to be open-ended until the parties provide written proof to the contrary.

Both the employer and employee have the right to revoke an employment contract, but revocation is not permitted arbitrarily and is governed by a strict system. This regime varies according to the term of the contract and the party terminating the contract. Finally, there are two exceptions to the general rule: if the contract included a probationary period or if the contract is terminated due to unprofessional conduct.

Notice Period 

Employers may legitimately terminate an open-ended contract with just cause and at least 14 working days' notice.

Severance Pay

Severance pay for redundancy is approximately 6.5 weeks' salary for up to five years of service and approximately 14 weeks' pay for ten years or more of service.

Probation Period 

A probation period should not exceed 6 months.
